Cancellation and Refund Policy

Overview

Our refund and returns policy lasts 30 days. If 30 days have passed since your purchase, we can’t offer you a full refund or exchange.

To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.

Several types of goods are exempt from being returned. Perishable goods such as food, flowers, newspapers or magazines cannot be returned. 

Additional non-returnable items:

  • Gift cards
  • Downloadable software products

To complete your return, we require a receipt or proof of purchase.

Please do not send your purchase back to the manufacturer.

There are certain situations where only partial refunds are granted:

  • Book with obvious signs of use
  • Software, video game, cassette tape, or vinyl record that has been opened.
  • Any item not in its original condition, is damaged or missing parts for reasons not due to our error.
  • Any item that is returned more than 30 days after delivery

Refunds

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.

If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.

Late or missing refunds

If you haven’t received a refund yet, first check your bank account again.

Then contact your credit card company, it may take some time before your refund is officially posted.

Next contact your bank. There is often some processing time before a refund is posted.

Sale items

Only regular priced items may be refunded. Sale items cannot be refunded.

Exchanges

We only replace items if they are defective or damaged. If you need to exchange it for the same item, send us an email at info@artdzigns.co.za and we will make arrangements with you to do the exchange.

Gifts

If the item was marked as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be mailed to you.

If the item wasn’t marked as a gift when purchased, or the gift giver had the order shipped to themselves to give to you later, we will send a refund to the gift giver and they will find out about your return.

Shipping returns

To return your product, you should mail your product to: 3 Zangwill Street, Uitsig, Kroonstad, 9499.

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

Depending on where you live, the time it may take for your exchanged product to reach you may vary.

If you are returning more expensive items, you may consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.

Digital Assets And Products

Our graphic design documents are available for download, and physical items are not shipped. Once payment is confirmed, downloads are delivered, and no refunds are available for completed projects due to the nature of the product and its delivery. If work is halted before completion, a cancellation penalty may apply, which will be evaluated on a case-by-case basis. Non-refundable down payments are required for all projects to initiate work.

Website Design

To ensure your satisfaction with the quality of our work and assess our team’s fit for your needs, we offer access to our extensive portfolio before being hired for project work. If you have any concerns or questions, please contact us before making a payment for our services.

For custom design projects, payments are made to us in increments as a courtesy to the client. To initiate work, 60% of the total project cost is required upfront, and the remaining 40% is due upon Website launch. All payments or deposits made are non-refundable. If a project is cancelled or postponed, ArtDzigns retains all monies paid, and if applicable, the client is responsible for a fee for all work completed beyond the amount already paid.

Website Maintenance

Clients are responsible for providing all digital format text and images/photos for new content added to a page, unless content creation services from ArtDzigns are requested. Unused hours cannot be rolled over to subsequent projects, and pass-through expenses’ used funds will be delivered to the client within 30 days of project completion and final reconciliation. No refunds are provided for unused hours or any fees related to Website maintenance services. A late payment or declined credit card charge will result in a R300 administrative fee charged to the client’s account. With a formal documented request, clients may cancel and renew without penalty provided they give a 60-day notice. ArtDzigns reserves the right to terminate the agreement at any time with written notice to the client.

Customers understand, acknowledge, and agree that ArtDzigns has no control over search engines or directories’ policies regarding the type of sites and/or content they accept, currently or in the future. A search engine or directory entity may exclude a customer’s Website(s) at any time at their sole discretion. It may take some search engines and directories as long as two (2) to four (4) months, or longer, after the plan’s commencement to list and/or update a customer’s Website. Listings may also be dropped for no apparent or predictable reason by search engines and directories.

ArtDzigns is not responsible for any changes made to a customer’s Website by other parties that negatively affect search engine or directory rankings for the customer’s Website.

Social Media Campaigns And Other Marketing Services

Clients are ultimately responsible for reviewing and approving all content before it is distributed into the market. ArtDzigns will provide proofs for review, which require formal written acknowledgement of completion prior to ArtDzigns executing the campaign or marketing tactic. Delays in timely review may result in the delay of tactic deployment, and ArtDzigns is not responsible for any reimbursement or credit for agreed-upon work in such circumstances. As a courtesy, payment schedules for campaigns and recurring marketing services may be invoiced monthly or quarterly, depending on client preference. Payments for recurring work are due no later than the intended date of deployment to commence work, and client payment delays will result in campaign/project delays. Clients may cancel and renew without penalty provided they give a 60-day notice with a formal documented request. ArtDzigns reserves the right to terminate the agreement at any time with written notice to the client.

Customized Workshops, Brand Guideline Development, And Digital Diagnostic Reports

All Workshops, Brand Guidelines, and Digital Diagnostic Reports are tailored to the unique needs of each client. ArtDzigns guarantees that no identical reports will be distributed to other clients, and the content of these reports will remain confidential and proprietary to the client. However, ArtDzigns reserves the right to anonymize these reports for marketing purposes, such as case studies. No identifiable information will be shared with other entities. Downloads of outputs from these offerings are provided upon receipt of full payment, and due to the nature of the product and its delivery, no refunds are available once the project is completed.

For any scheduled Workshops, the client must provide at least 5 business days’ notice to change the meeting date/time. Failure to do so within the given timeframe will result in a penalty fee not exceeding the cost of the project itself. The costs associated with cancellation or rescheduling will be determined on a case-by-case basis. Should a request for work to be stopped before the project is completed, a cancellation penalty may apply and will be assessed on an individual basis. Down payments are required to initiate all projects and are non-refundable.

Indemnification

Customer agrees to indemnify and hold harmless ArtDzigns (as well as its subsidiaries, affiliates, officers, agents, co-branders, partners, and employees) from any and all claims, damages, liabilities, costs, and expenses (including, but not limited to, reasonable attorneys’ fees and all related costs and expenses) arising from (a) any information, content, or material (whether written, graphic, sound, or otherwise) provided by Customer to ArtDzigns (the “Customer Content”), or (b) any claim that ArtDzigns use of the Customer Content infringes the intellectual property rights of a third party. ArtDzigns must provide prompt written notice of a claim to Customer, and Customer will control and fully cooperate with ArtDzigns in the defense and all related negotiations to qualify for such defense and payment.

Disclaimer

ArtDzigns does not guarantee that its marketing services will meet the customer’s expectations or requirements. The customer assumes all risk regarding the quality and performance of the services provided. ArtDzigns provides its services “as is” and without warranty of any kind, except as otherwise specified in this agreement. Both parties agree that the limited warranties outlined in this section are the only warranties provided, and each party disclaims all other warranties, whether express or implied, including but not limited to, the implied warranties of merchantability and fitness for a particular purpose, related to this agreement, performance under this agreement, the content, and each party’s computing and distribution system. If any provision of this agreement is found to be unlawful, void, or unenforceable for any reason, that provision shall be considered separate from this agreement and will not affect the validity and enforceability of any remaining provisions.

Limited Liability

ArtDzigns shall not be liable to Customer for any indirect, special, exemplary or consequential damages, including any implied warranty of merchantability or fitness for a particular purpose or implied warranties arising from course of dealing or performance, lost profits, whether or not foreseeable or alleged to be based on breach of warranty, contract, negligence or strict liability, arising under this Agreement, loss of data, or any performance under this Agreement. This limitation of liability applies regardless of the form of action, whether in contract, tort (including negligence), strict liability, or otherwise, and even if ArtDzigns has been advised of the possibility of such damages and notwithstanding the failure of essential purpose of any limited remedy provided herein. ArtDzigns does not offer refunds. Additionally, ArtDzigns makes no warranty of any kind, whether express or implied, with regard to any third-party products, third-party content or any software, equipment, or hardware obtained from third parties.

Confidentiality

The parties shall maintain strict confidentiality of each other’s proprietary or confidential information. This includes, but is not limited to, written or oral contracts, trade secrets, business methods, business policies, know-how, memoranda, reports, records, financial information, notes, and computer retained information.

Force Majeure

Neither party shall be held liable for any delay or failure to perform their obligations under this Agreement due to any cause or condition beyond their reasonable control that cannot be overcome through commercially reasonable efforts. Such causes or conditions may include, but are not limited to, acts of God, acts of government, acts of war, natural disasters, or other emergencies. In the event of any force majeure event, the affected party shall promptly notify the other party in writing and use commercially reasonable efforts to minimize the impact of such event. By utilizing our services, you acknowledge that you have carefully read and fully understand this Agreement, and agree to be legally bound by its terms and conditions.

Print Media Design

The design costs paid to ArtDzigns are non-refundable. However, if there is a printing error due to our fault, the printing costs paid to ArtDzigns are refundable. We cannot be held liable for any damages resulting from printing errors or issues arising from our files if the full specifications provided by your printer were not accurate or if incorrect/inaccurate files were supplied to your printer. The design files will be provided to you via email or online only, and no physical items will be shipped to you.
